New EU Chemical Hazard Classes Impacting Shipping from China

This memo serves to inform you of a significant regulatory update from the European Union that will impact the compliance of your supply chain for chemicals and mixtures sourced from China. The EU Commission Delegated Regulation (EU) 2023/707, amending the Classification, Labeling and Packaging (CLP) Regulation ((EC) No 1272/2008), was published on March 31, 2023. This revision introduces entirely new hazard classes, directly affecting the classification, labeling, packaging, and consequently, the international transportation documentation for a wide range of chemical substances and mixtures (including paints, inks, adhesives, cleaners, etc.) destined for the EU market.

Key Updates & Their Logistics Implications:

Introduction of New Hazard Classes:

The regulation formally establishes the following new hazard categories for classification purposes:

  • Endocrine Disruptors (EDs) for human health or the environment.
  • PBT/vPvB substances (Persistent, Bioaccumulative and Toxic / very Persistent and very Bioaccumulative).
  • PMT/vPvM substances (Persistent, Mobile and Toxic / very Persistent and very Mobile).

Logistics Impact: Substances or mixtures classified under these new categories will require assignment of the appropriate UN Number, Proper Shipping Name, and Hazard Class/Division for international multimodal transport (sea, air, road), based on their specific hazards. Shippers must provide updated Safety Data Sheets (SDS) and compliant labeling. Failure to do so may result in shipment delays, fines, or rejection at ports of loading, transit, or destination.

Mixture Classification Thresholds:

The regulation states that a mixture containing 0.1% or more (by weight) of any substance falling under the new hazard classes may be classified as dangerous. Consequently, many products previously shipped as "general chemicals" may now need to be handled as Dangerous Goods (DG). This entails using UN-certified packaging, obtaining a Package Performance Test Certificate, applying correct transport labels/markings, and booking space with carriers certified to handle dangerous goods.

Critical Compliance Timeline (From a Shipping Perspective):

  • Substances: New substances placed on the EU market must comply starting May 1, 2025. Existing stock already on the market must comply by November 1, 2026. All related transport documents must reflect the new hazard properties after these dates.
  • Mixtures: New mixtures placed on the market must comply with the ED criteria starting May 1, 2026. Existing stock must comply by May 1, 2028. Logistics planning should be adjusted accordingly.

Action Items for International Purchasers:

  • Communicate with Suppliers: Immediately inform your Chinese suppliers of this regulation. Request they review product formulations to determine if they fall under the new classification criteria.
  • Request Updated Documentation: For future orders, explicitly require suppliers to provide an SDS compliant with (EU) 2023/707 (pay close attention to Sections 2, 3, 9, 14, 15) and product labels. This is the legal basis for correct transport classification and documentation.
  • Adjust Logistics Planning: Anticipate potential delays in documentation review, booking, packaging, and customs clearance for chemical shipments, especially those newly classified as DG, around the enforcement dates. Build buffer time into your shipping schedules and maintain close communication with your freight forwarder.
  • Assess Cost Impact: DG transportation typically incurs higher costs for specialized packaging, documentation, freight, and insurance. Factor potential compliance and logistics cost changes into your total procurement cost analysis.
