Summary of Key Updates in the EU's Revised Safety Data Sheet (SDS) Regulation (EC) 2020/878: Implications for Logistics
Background
To align with the latest revisions (Rev. 6 & 7) of the UN Globally Harmonized System of Classification and Labelling of Chemicals (GHS) and integrate requirements from EU regulations such as REACH and the Poison Centre Notification (PCN), the European Commission published Commission Regulation (EC) 2020/878 on June 26, 2020. This regulation amends Annex II of REACH (detailing requirements for SDS compilation) and became mandatory on January 1, 2021.
Key Revisions with Logistics Relevance
Introduction of the Unique Formula Identifier (UFI)
In accordance with the EU PCN Regulation ((EU) 2017/542), hazardous mixtures placed on the EU market must now include a Unique Formula Identifier (UFI) in Section 1 of the SDS. This UFI links the SDS to the detailed product composition information submitted to EU Member State-appointed bodies (Poison Centres). In the event of a transportation incident, emergency responders across the EU can use this UFI to instantly access identical, precise product information for medical and environmental response, which is critical for hazardous material (hazmat) incident management during shipping.
Explicit Identification of Nanoform Substances
For substances placed on the market in a nanoform, this must be clearly indicated with the term "nanoform" in Section 1. Furthermore, relevant particle characteristics must be provided in Section 3.2, depending on the registration status within the supply chain. This information is vital for accurate hazard classification, which directly impacts shipping descriptions, UN numbers, and packaging groups under transport regulations like the IMDG Code (sea) and IATA DGR (air).
New Information Requirements for Endocrine Disruptors
Substances or mixtures meeting the criteria for endocrine disrupting properties per (EU) 2017/2100 or (EU) 2018/605 require additional disclosures:
- Section 2.3 (Other hazards): Notification
- New Sub-section 11.2 (Other hazards): Summary information
- New Sub-section 12.6 (Endocrine disrupting properties): Description of adverse environmental effects
Awareness of these properties is important for long-term regulatory compliance under REACH (e.g., SVHC status), which can affect product market access and supply chain sustainability.
Enhanced Composition Disclosure
Where available, Specific Concentration Limits (SCLs), Multiplier Factors (M-factors), and Acute Toxicity Estimates (ATEs) for substances must now be included in Section 3.2. This supports more precise hazard determination and classification for transport.
Refined Requirements for Physicochemical Data
More detailed reporting requirements are specified for Section 9 (Physical and chemical properties), including clarifying the applicability of data to the mixture or its components. Data relevant to physical hazard assessment must also be comprehensively reported.
Acceptance of (Q)SAR Data for Ecotoxicology
In the absence of experimental data for Section 12 (Ecological information), reliable (quantitative) structure-activity relationship ((Q)SAR) model data is now acceptable.
Summary of Key Changes
- UFI (Unique Formula Identifier): Mandatory in Section 1 for hazardous mixtures - enables rapid emergency response
- Nanoform Substances: Explicit identification required - affects transport classification
- Endocrine Disruptors: New disclosure requirements in Sections 2, 11, and 12
- Enhanced Composition: SCLs, M-factors, and ATEs now required in Section 3.2
- Physicochemical Data: More detailed reporting in Section 9
- (Q)SAR Data: Accepted for ecotoxicology when experimental data unavailable
Grandfathering Period
To facilitate a smooth transition for industry, SDSs compiled according to the previous standard, Commission Regulation (EU) 2015/830, remain valid until December 31, 2022. After this date, all SDSs for substances and mixtures placed on the EU market must be fully compliant with (EC) 2020/878.
π Key Deadline: December 31, 2022
All SDSs for substances and mixtures placed on the EU market must be fully compliant with (EC) 2020/878 after this date.
β Ensure suppliers provide SDS compliant with (EC) 2020/878 for EU-bound shipments
β Verify UFI is included in Section 1 for hazardous mixtures
β Check nanoform identification where applicable
β Update dangerous goods classification based on enhanced hazard data
β Plan for transition - grandfathering ends December 31, 2022
